All Virtual Currency transactions are instantaneous and irrevocable upon completion of the payment process.
By completing a purchase of Virtual Currency, you acknowledge and agree that: (i) you are purchasing digital content that is delivered immediately and consumed upon delivery; (ii) the Virtual Currency has no monetary value outside of the Service and cannot be redeemed for cash, refunded, resold, or transferred; (iii) all sales of Virtual Currency are final and shall not be reversed, refunded, or credited under any circumstances after the transaction is completed, except as may be required by applicable law; and (iv) you bear sole responsibility for ensuring that your purchase details, including the correct account and quantity, are accurate prior to completing any transaction.
Virtual Currency is provided for use within the Service only, under a limited, non-exclusive, non-transferable, revocable license. Virtual Currency does not constitute tangible personal property, a security, or any form of legal tender or currency recognized by any governmental authority.
Chargebacks and Payment Disputes
You agree that any initiation of a chargeback, payment dispute, or reversal of a payment through your payment processor, card network, or financial institution — without our prior written consent and without a legitimate, good-faith basis — shall constitute a material breach of these Terms of Service.
In the event of a chargeback initiated in bad faith or without a legitimate basis, you agree to indemnify, defend, and hold harmless Consala International Inc and its officers, directors, employees, and agents from and against any and all claims, damages, liabilities, costs, and expenses (including reasonable attorneys' fees) arising from or related to such chargeback, including but not limited to chargeback fees, processing fees, penalties, and any other amounts assessed by payment processors or financial institutions.
Without limiting any other remedy available to us at law or in equity, in the event of a chargeback initiated without a legitimate basis, we reserve the right to: (i) suspend or permanently terminate your account and your access to the Service; (ii) suspend or revoke any and all Virtual Currency, virtual goods, or digital entitlements associated with your account; (iii) withhold or recover any Virtual Currency, virtual goods, or value obtained through the disputed transaction; and (iv) pursue any and all available legal remedies for the recovery of amounts owed, including chargeback fees, processing costs, and attorneys' fees.
If you have a billing error, unauthorized transaction, or other legitimate dispute regarding a purchase, your exclusive remedy is to contact us directly at the contact information provided in the "Contact Us" section below prior to initiating any chargeback or payment dispute. We will work in good faith to resolve any legitimate disputes directly with you. Initiating a chargeback with your card issuer without first giving us an opportunity to resolve the dispute directly shall be deemed a violation of these Terms.
